I’d want to know a bit about the barely-referenced Swiss court case that is apparently the reason for this before jumping to conclusions.

Really? Have you no experience with hourly work or retail environments? It’s rather common practice, at least here in the USA and of what I know of Canada. Restroom breaks are typically expected to be during an employee’s scheduled break time or offset by deduction from break time for unscheduled leave for the restroom. It can happen with salaried workers as well if they’re unavailable for extended periods and seen as abusing allotted break time. Worked in retail and on factory floors many moons ago, but never had to clock out to go to the loo. It shouldn't matter where you work, making employees clock in and out to go to the toilet is degrading. Ciggie breaks are a different thing and rightly so. That's a choice, so save it for designated break times.
